S.M.A.R.T. In Concepts/The Solution Guru Brands. ("SMART In Concepts") websites (collectively, the "Website"), all other products and services, including mobile applications, owned, controlled or offered by SMART In Concepts, and all content offered as part thereof, are collectively referred to herein as the "Services." Subscribers, account holders, customers, users, and others who download, access, use, and/or subscribe to the Services (the "User" or "you") are required to agree to the following terms and conditions (the "Terms of Service"). Your use of the Services, constitutes your acceptance of and agreement to all of the terms and conditions in the Terms of Service and the Privacy Policy. The Terms of Service govern your use of the Services and are a condition to your use of the Services. If you object to anything in these Terms of Service and the Privacy Policy, you are not permitted to use the Services.

Accountability Coaching is not a counseling service. S.M.A.R.T. In Concepts do not provide clinical counseling or psychotherapy. Accountability Coaching is not to be a substitute for clinical counseling, treatment for suicide ideation, depression or severe psychiatric problems. The information provided by S.M.A.R.T. In Concepts,does not constitute legal advice and neither is it intended to be. It is to be used for educational and personal growth purposes only.
As a client it is important to understand the difference between Accountability Coaching and clinical counseling or psychotherapy. While there are similarities between Accountability Coaching and clinical counseling / psychotherapy, the main differences are in the goals, focus and level of professional responsibility. Accountability Coaching is intended to supplement personal learning and growth with proactive strategies and personal accountability. Clinical counseling / psychotherapy is a health care/medical service and is usually reimbursable through health insurance policies. Accountability Coaching is not a health care or medical service. Therefore, coaching services are not reimbursable through health insurance policies.
It is also important to understand that coaching is a professional relationship. While it may often feel like a close personal relationship, it is not one that can extend beyond professional boundaries either during or after work together. Considerable experience shows that when boundaries blur, the benefits gained from the coaching relationship are endangered.

RELEASE OF LIABILITLY
The client agrees that using any of these Accountability Coaching services are entirely at his/her own risk. Accountability Coaching services are provided “as is,†without warranty of any kind, either expressed or implied, including without limitation any warranty for information services, coaching, uninterrupted access, or products and services provided through or in connection with the service. This service is requested at the client’s own choice and with inherent singular responsibility.
The client agrees that the use of all, or part, of the service is entirely at the client’s own risk. Any actions or lack of actions, taken by the client of such advice is done so solely by choice and responsibility of the client and is neither the responsibility nor liability of S.M.A.R.T. In Concepts. The client understands that Accountability Coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and the client will not use it in place of any form of therapy.
The client recognizes that coaching requires emotional, physical and mental efforts, exertion and behavioral experimentation, on the client’s part, which may cause physical, mental or emotional injury. S.M.A.R.T. In Concepts cannot be held responsible for actions or inactions taken by the client based upon coaching or interpretation of coaching given to the client. The client fully acknowledges and takes full responsibility for all the risks involved. The client understands that it is her/her responsibility to consult with his/her primary health care provider prior to participant and should the client choose not to consult his/her health care provider, the client accepts full responsibility waiving all rights to liability or any claims against S.M.A.R.T. In Concepts, any of its agents, administrators, or employees. The client attests to the fact that the client has disclosed all relevant information regarding his/her physical, emotional or mental conditions that could cause harm to the client by participating in these programs. The client or legal representatives forever release, wavier, discharge and covenant not to sue S.M.A.R.T. In Concepts for any injury, harm or death caused by either negligence or other acts. The client has read and understood this form and all its contents, and the client voluntarily agrees to the terms and conditions stated above.

CONFIDENTIALITY
The client understands that information will be held as confidential unless the clients states otherwise in writing. If the client reports child or elder abuse or neglect or threaten to harm oneself or someone else, the client understands necessary actions will be taken and my confidentiality agreement limited in this capacity. Further more, if S.M.A.R.T. In Concepts, is ordered by a court to provide information or testify, we will do so to the extent the law requires. Additionally, the client understands that use of technology is not always secure and accepts the risks of confidentiality in the use of email, text, phone, Skype, and other technology.
MODIFICATION OF TERMS OF SERVICE AND/OR SERVICES
SMART In Concepts reserves the right, in its sole discretion, to modify, discontinue or terminate the Services or to modify these Terms of Service at any time and without prior notice. If SMART In Concepts amends these Terms of Service, it will update this posting on the Website and specify the effective date of the new version of the Terms of Service. Your continued use of the Services following the posting of a new version of the Terms of Service shall constitute your acceptance of any such amendments. Accordingly, you should check to see if a new version of the Terms of Service has been posted each time you use the Services. If the amended Terms of Service are not acceptable to you, your only recourse is to cease using the Services.
